Welcome to FhETCH.onlinePlatform. By creating an account, accessing, or using any part of this Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, you must not use the Platform.

1. Introduction

FhETCH.online serves as a digital marketplace and engagement platform that connects users with verified businesses for the purpose of sharing updates, booking services, and purchasing goods online. The Platform is intended solely for lawful and legitimate commercial and social interactions.

2. Eligibility and Acceptance

By registering or using this Platform, you confirm that you are at least 18 years old and legally capable of entering into binding agreements, and that all information provided is accurate and truthful. Continued use of the Platform constitutes acceptance of these Terms and our Privacy Policy.

3. Business Verification and FhETCH Number

All businesses must undergo a verification process before transacting through the Platform. Each verified business is assigned a unique FhETCH Number which must be used for all official transactions. Transactions involving unverified businesses are not endorsed or protected by FhETCH.online.

4. Prohibited Activities

Users and businesses are strictly prohibited from engaging in illegal or unethical activities, including but not limited to:

• Drug trafficking or distribution of controlled substances
• Child exploitation, trafficking, or abuse
• Sale or promotion of illegal goods or services
• Impersonation or misrepresentation of individuals or entities

Special Notice: Pharmacies may only list and sell over-the-counter (OTC) medications. The advertisement or sale of prescription-only drugs is strictly forbidden.

5. Responsibilities of Users

Personal (individual) user accounts on FhETCH.online are free to open and operate. Users may explore business listings, post inquiries, interact with verified businesses, and access general Platform services at no cost, unless otherwise specified for premium or promotional features.

All users are required to comply with applicable Kenyan laws and any relevant international regulations when using the Platform. Users shall:

• Engage only with verified businesses displaying an official FhETCH Number;
• Provide accurate personal information during registration and keep their details up to date;
• Maintain the confidentiality of login credentials and restrict unauthorized access to their accounts;
• Promptly report any suspicious, fraudulent, or illegal activity encountered on the Platform.

FhETCH.online reserves the right to suspend or terminate any user account found to be involved in prohibited, abusive, or deceptive practices.

6. Responsibilities of Businesses

Businesses registered on FhETCH.online must provide accurate information, comply with legal and professional standards, disclose limitations of their goods or services, and refrain from misleading advertising or false claims.

7. Platform Rights and Administration

FhETCH.online reserves the right to verify, suspend, or terminate any account that violates these Terms. We may modify or remove content, investigate suspicious activity, and cooperate with law enforcement when required.

8. Limitation of Liability

FhETCH.online acts solely as a facilitator between users and businesses. We do not guarantee the quality, legality, or authenticity of goods or services. All transactions are conducted at the user’s own risk. We are not liable for indirect, incidental, or consequential losses arising from Platform use.

9. Compliance with Laws

All users and businesses must comply with applicable Kenyan laws, including the Kenya Information and Communications Act and the Consumer Protection Act. International users must also adhere to the laws of their jurisdictions.

10. Privacy and Data Protection

Personal and business data is collected and processed in accordance with our Privacy Policy. By using this Platform, you consent to electronic communication for verification, notifications, and transactions.

11. Account Suspension and Termination

We reserve the right to suspend or terminate any account involved in unlawful conduct, breach of these Terms, or actions compromising Platform integrity. Termination does not relieve users or businesses of obligations incurred prior to termination.

12. Modifications to These Terms

We may revise or update these Terms at any time. Users will be notified of significant updates via email or in-platform notice. Continued use after modification constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved exclusively within the courts of Kenya.

15. Subscription and Renewal Policy

Businesses operating on FhETCH.online are required to maintain an active subscription. Renewal ensures continued visibility, transaction eligibility, and verification validity on the Platform.

Renewal Period: Every month from the date of approval or last renewal.

Applicable Renewal Fees:

• Restaurants – Ksh 1,500
• Shops / Supermarkets – Ksh 1,500
• Hospitals – Ksh 2,500
• Pharmacies – Ksh 2,000
• House Rentals – Ksh 1,500
• Wholesalers – Ksh 2,500
• Schools – Ksh 1,500
• Other Business Types – Ksh 1,500

Payment may be made through M-PESA or PayPal as selected by the user at checkout. Renewal payments are non-refundable once processed, except in cases of system error or duplicate transaction.

Failure to renew by the due date may result in temporary suspension or removal of the business profile until payment is completed.
